Description

This is a voluntary ex ante transparency (VEAT) notice. DVLA intends to award a further contract to NSL Limited for the continued provision of Enforcement Services commencing on 1st February 2026 for 9 months with the option of a 3 month extension.
The standstill period as prescribed by the Public Contract Regulations 2015 will conclude at 23:59 on Monday 13 January 2025
This extension is to ensure continuity of service and also to allow a full twelve month implementation period for the successful bidder (currently unknown) for the long term Enforcement contract PS 23 45. This procurement is currently live. This requirement was highlighted during market engagement as an essential requirement to a successful implementation. 
DVLA intends to award the contract without a call for competition in accordance with the following provisions of The Public Contracts Regulations 2015. 
32.2 (b) ii.
The works, supplies or services can be provided only by a particular economic operator for the following reason:
• absence of competition for technical reasons
32.2 ( c) insofar as is strictly necessary where, for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for the open or restricted procedures or competitive procedures with negotiation cannot be complied with.
72.1 (b) . Contracts and framework agreements may be modified without a new procurement procedure in accordance with this Part in any of the following cases:—
for additional works, services or supplies by the original contractor that have become necessary and were not included in the initial procurement, where a change of contractor—
(i)	cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, services or installations procured under the initial procurement, or
(ii)	would cause significant inconvenience or substantial duplication of costs for the contracting authority.
provided that any increase in price does not exceed 50% of the value of the original contract;
72.2 ( c) where all of the following conditions are fulfilled:—
(i)	the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen [such as covid impact on public services ]
(ii)	the modification does not alter the overall nature of the contract;
(iii)	any increase in price of the value of the original contract or framework agreement.

Enforcement Agents

The scope of the contract is to provide an enforcement service to take all necessary steps to collect unpaid Business Rates, Business Improvement Levy, Council Tax and unpaid Parking and Traffic warrants. There is also an option to extend the service to other debt types such as commercial rent, unpaid housing rent, and unpaid miscellaneous income debts. The scope of the contract is further detailed in the Specification document. It is the City’s intention to award contracts to the three top ranked bidders with the highest overall tender scores. The City’s Revenue’s team will work directly with the top two, and the 3rd placed bidder will be reserve supplier (used on a contingency basis), dependent on volume and performance of the top two. The City’s Parking Ticket team will work directly with each of the top 3 bidders. For the call-off process relating to the distribution of work across successful bidders, please see Appendix D of the service specification – Tender Specification document. Parking enforcement will award cases equaling all three of the top scoring bidders.  This tendering exercise is being undertaken using the electronic tendering system ‘City of London Corporation Sourcing & Contracts Portal’ (https://cityoflondon.ukp.app.jaggaer.com/). Suppliers will need to register an interest on the system in order to participate and registration is free. The estimated contract value given at sections 31 and 32 is for the full duration of the contract including the maximum possible extensions. The estimated annual contract value is therefore £6,518,000.
