Description

Buckinghamshire Council is seeking a Provider/s to provide Care and Support under 2 block\r
contract arrangement within 13 supported living services, 7 locations supporting people with\r
a learning disability/autism and 6 locations supporting people with mental health conditions.\r
The services vary in size and support a total of 124 service users.\r
The Provider will provide high quality and person-centred care and support for people\r
assessed by the Council or in exceptional circumstance the Integrated Care Board (ICB) as\r
being eligible for health and social care support under the provisions of The Care Act 2014\r
and The National Framework for NHS Continuing Healthcare and NHS Funded Nursing Care\r
2022.\r
The Provider must be a Care Quality Commission (CQC) Registered Provider to deliver this\r
regulated activity. The Provider must have a good track record and be rated by CQC as\r
'Good' or above in 50% of their registered service portfolio or be rated 'Good' or above if\r
they only have one other service. The Provider must have in post a registered person or\r
Director who must have the qualifications, competence, skills, and experience necessary for\r
the role. The Registered person or Director must not have been responsible for any serious\r
misconduct or mismanagement while carrying out a regulated activity.\r
The ownership of the properties is split between 4 Registered Landlords, it being a\r
Page 4 to 8\r
prerequisite for any contract award that any new care provider enters into agreements with\r
these landlords for the purpose of using office accommodation (where this is available), and\r
(where this is necessary) delivering housing management functions, on site.\r
The Provider is required to deliver services via its support workers based at the locations 24\r
hours a day, 365 days a year, including bank holidays and public holidays as required to meet\r
the needs of Service Users within the Establishments.\r
The Provider will ensure that all Staff have a new Disclosure and Barring Service (DBS) check\r
carried out prior to undertaking work with Service Users and shall renew existing staff\r
checks at regular intervals in line with guidance from the DBS service. Staff will be required\r
to have the highest level of DBS check in accordance with the safe and fair recruitment guide\r
set by Skills for Care.\r

The Council is conducting the procurement under the "Light Touch Regime" as set out in
regulations 74-77 in the Public Contracts Regulations 2015 (PCR 2015).
The Contract Value is the estimated value for the initial 5 year period across both Lots excluding the 2 year option to extend and may be subject to inflationary increases

The Outreach Short Breaks Service is a specialist provision providing home-based and community-based support to children and young people assessed as eligible by the SEND FHS. This service specification has two separate Lots. Lot One: At home and/or community support Provide care to a child or young person with medium or high needs at home, or to support with accessing community facilities. Lot Two: Group based community activities Provide group-based community activities for children and young people with medium or complex needs. The agreement is based upon the basic principles of a framework agreement, and although there are some similar aspects, it does not fully operate in the same way as outlined in regulation 33 of the Public Contracts Regulations (2015). The Local Authority will create a “pseudo framework agreement” (based on CCS guidance) and have set out clearly how we intend to operate the framework agreement from the outset through the OJEU notice, Tender Document and Call-off Schedule, which also details the timeline for when it will be reopened. This meets the duty of transparency and equal treatment, which are the main guidelines to follow when setting up an LTR framework
