Description

This contract is for the delivery of Statutory Social Care and Health (NHS) Complaints Advocacy Service for Adults and Children in Devon and Torbay. \r
It is split between two lots as follows:\r
Lot 1 -  Statutory Adult Social Care and Health (NHS) Complaints Advocacy Service in Devon and Torbay.\r
Lot 2 - Children & Young People's Advocacy Service \r

Lot 1 - Statutory Adult Social Care and Health (NHS) Complaints Advocacy Service in Devon and Torbay.\r
This contract covers the provision of statutory advocacy services for adults in receipt of social care support who meet the eligibility criteria for such advocacy, and who require NHS Complaints Advocacy support when interacting with the NHS Devon part of the health and social care system.\r

The Service Provider who holds this Lot contract will be required to supply advocacy based on the requirements of the following legislation:\r
- The Care Act 2014\r
- The Mental Capacity Act 2005\r
- The Mental Health Act 1983 (as amended in 2007)\r
- NHS Complaints Advocacy as required under The Health and Social Care Act 2012\r

Lot 2 - Children & Young People's Advocacy Service \r
Under Section 22(4) of the Children Act (1989), the Local Authority must ascertain the wishes and feelings of any child who is, or at risk of becoming, a child looked after, being able to make any decisions about their lives.  Every child looked after, including homeless young people aged 16 and 17 years and young people in secure accommodation has a right to be supported by an advocate through the care planning and review processes. \r

In particular the local authority should ensure that children who have difficulty in expressing their wishes and feelings are supported by an advocate who has the appropriate expertise to understand the child's means of communication.  This includes disabled children and young people with complex communication needs (The Children Act 1989 Guidance and Regulations Volume 2: The Care Planning, Placement and Care Review 2010; the IRO Handbook: Statutory Guidance for Independent Reviewing Officer and local authorities on their functions in relation to care management and review for looked after children 2010)\r

The Service Provider for this Lot contract will provide advocacy services for the following:\r
- Children subject to Child Protection\r
- Children Looked After and Care Leavers\r
- Health and Social care Complaints  \r
- Visiting Advocacy Services to Atkinson Secure Children's Home\r

Monitoring of School Attendance of Children and Young People in Care and Children and Young People with an Education, Health & Care Plan (OOC). Wolverhampton City Council (the Council) has a statutory duty to monitor the school attendance of children and young people in care placed in out-of-city independent placements, and for children and young people with Education, Health and Care Plans (EHCPs) attending out-of-city education settings. This duty is primarily governed by the Education Act 1996 and relevant Department for Education (DfE) statutory guidance. To fulfil this responsibility, the Council requires a service provider capable of delivering a robust service for collecting and monitoring attendance data for these two cohorts. The overarching aim is to improve school attendance among Wolverhampton pupils placed outside the city by delivering an effective, responsive, and informative service. This will enable the Council to identify and address poor attendance early, ensuring timely intervention in cases of unauthorised absence. The provider will be expected to achieve the outcomes outlined in the performance indicators and the successful provider is expected to deliver as follows: * Implement a robust and efficient attendance monitoring service that ensures accurate and timely collection of attendance data for all education provisions. * The service should support multiple methods of data acquisition to maximise coverage and reliability. This may include: • Automated extraction of attendance data from education management systems, where integration with the school or setting's system is both feasible and secure, • Alternative communication methods, such as direct phone call with provisions or settings, to ensure attendance data is captured even where MIS integration is not possible.
